*TERMS AND CONDITIONS FOR STAY AND RENTAL OF THE NOGATODKUCHNI COTTAGE*

1. General Provisions

1.1. These Terms and Conditions set out the rules governing reservations, payments and stays at the NogatOdKuchni holiday cottage, located at Nogat 29Y, 86-320 Nogat, Poland.

1.2. By making a reservation, the person making the reservation confirms that they have read and accepted these Terms and Conditions.

1.3. A reservation is confirmed upon payment of the required advance payment.

1.4. The person making the reservation, hereinafter referred to as the “Guest”, is responsible for ensuring that all other persons included in the reservation comply with these Terms and Conditions.

1.5. Guests are required to use the property in accordance with its intended purpose and applicable safety rules, respect the furnishings and equipment, and ensure that other guests and local residents can enjoy a peaceful environment.

2. Reservations and Payments

2.1. Reservations can be made by telephone, email or WhatsApp.

2.2. Confirmation of a reservation requires an advance payment of PLN 500, payable by bank transfer or BLIK within 2 days of making the preliminary reservation, unless otherwise agreed by the parties.

2.3. Failure to pay the advance payment within the specified period may result in the cancellation of the preliminary reservation.

2.4. The remaining balance for the stay must be paid no later than the day of arrival, before the property is handed over to the Guests. Payment may be made in cash, by bank transfer or by another agreed payment method.

2.5. A refundable security deposit of PLN 500 is payable on the day of arrival. The deposit serves as security against any damage, missing equipment or other outstanding charges related to the stay.

2.6. The security deposit will be refunded after the stay, once the condition of the cottage and its equipment has been checked. If any damage or missing items are identified, the Owner may deduct an amount corresponding to the reasonable costs of repair, replacement or remedying the damage. If the damage exceeds the amount of the security deposit, the Guest is required to cover the remaining cost.

3. Check-in and Rules of Stay

3.1. The stay begins at 4:00 p.m. on the day of arrival and ends at 10:00 a.m. on the day of departure. Different arrival or departure times may be arranged in advance with the Owner.

3.2. Pets are not permitted on the property unless the Owner has given prior consent. In the event of a breach of this rule, the Guest may be charged reasonable additional costs for cleaning, disinfection or repairing any resulting damage.

3.3. Smoking cigarettes, electronic cigarettes and other tobacco products is strictly prohibited inside the cottage. Smoking is permitted outdoors only in designated areas.

3.4. Any unauthorised interference with smoke detectors, carbon monoxide detectors or other safety devices is strictly prohibited, particularly their removal, covering or disabling. The Guest is liable for any damage and reasonable costs arising from such actions.

3.5. Parties, hen parties, stag parties and other entertainment events that may disturb the peace or comfort of others are strictly prohibited on the property.

3.6. Quiet hours apply on the property from 10:00 p.m. to 6:00 a.m. Guests must behave in a manner that does not cause excessive noise or disturbance to local residents.

3.7. The number of people staying on the property must not exceed the number agreed upon at the time of reservation without the Owner’s prior consent.

3.8. In the event of a serious or repeated breach of these Terms and Conditions, safety rules or public order, the Owner may require the Guest to cease the violation and, in particularly justified circumstances, terminate the stay in accordance with applicable law.

4. Accommodation Price and Additional Charges

4.1. The accommodation price includes electricity consumption of up to 30 kWh for each commenced 24-hour period of the stay. Any consumption exceeding this limit will be charged at PLN 1.20 per additional kWh.

Electricity consumption is calculated based on meter readings taken at the beginning and end of the stay. These readings may be documented photographically. Any additional charge must be settled no later than the last day of the stay. The limit applies to the total electricity consumption throughout the property.

4.2. The accommodation price includes the use of the amenities available on the property, including the sauna, hot tub, stand-up paddleboard (SUP) and fishing boat, subject to safety rules and applicable Polish law.

4.3. Firewood for the campfire, sauna and hot tub is provided to Guests as part of their stay.

5. Personal Data

5.1. Guests’ personal data is processed to the extent necessary to make reservations, provide accommodation, settle payments and fulfil obligations arising under applicable law.

5.2. Detailed information regarding the processing of personal data, the legal grounds for processing and the rights of data subjects is set out in the Privacy Policy available on the property’s website.

6. Liability and Safety

6.1. The Guest is liable, in accordance with applicable law, for any damage to the cottage, its furnishings and equipment, or the property grounds caused by the Guest or any person included in the reservation.

6.2. Guests must comply with all safety and fire prevention rules throughout their stay.

6.3. For safety reasons, the outdoor areas of the property are monitored by CCTV. The monitoring system does not cover the interior of the cottage or areas intended to ensure Guests’ privacy.

6.4. Children may use the property grounds, playground, water equipment and other amenities only under appropriate parental or guardian supervision. Parents or guardians are responsible for supervising minors.

6.5. The wood-burning stove may be operated by adults only, in accordance with its intended purpose and applicable safety rules. Anyone unfamiliar with the correct and safe operation of the stove is asked not to use it and to contact the Owner.

6.6. The gas barbecue may be operated by adults only, in accordance with its intended purpose and applicable safety rules. If the Guest has any doubts about how to operate the appliance, they must refrain from using it and contact the Owner.

7. Use of Equipment and Additional Amenities

7.1. Guests must use the water equipment, sauna, hot tub, playground, barbecue, campfire area, wood-burning stove and all other appliances and facilities in accordance with their intended purpose and applicable safety rules.

7.2. Before using any equipment, the Guest should check that it has no visible damage that could affect its safe operation.

7.3. If any damage, malfunction or other irregularity is noticed, the Guest must stop using the equipment and notify the Owner immediately.

7.4. Children may use the equipment and available attractions only under adult supervision.

7.5. When using water equipment, Guests must use the safety equipment provided and ensure that their use of the equipment is appropriate to the weather conditions and their own abilities.

7.6. The use of water equipment, the sauna, hot tub, bicycles, barbecue, fire pit and other appliances in a manner contrary to their intended purpose or that creates a risk to the user or other persons is prohibited.

7.7. The Guest is liable, in accordance with applicable law, for any damage resulting from improper use of the equipment provided or use contrary to its intended purpose.

8. Damage and Furnishings

8.1. The Guest must notify the Owner immediately of any damage, breakdown or damage to the furnishings and equipment.

8.2. Guests are prohibited from carrying out repairs themselves or interfering with installations and appliances on the property without the Owner’s consent.

8.3. The Guest is liable for damage caused by the Guest or any person included in the reservation. Normal wear and tear resulting from proper use of the property is not considered damage.

9. Additional Guests

9.1. Only the number of people agreed upon at the time of reservation may stay overnight at the property.

9.2. Overnight stays by persons not included in the reservation require the Owner’s prior consent.

10. Departure

10.1. Upon departure, the Guest must leave the cottage and its furnishings and equipment in good condition, close all windows and doors, and return the keys provided.

10.2. Leaving the property in a condition that requires cleaning beyond the standard level may result in the Guest being charged reasonable additional cleaning costs.

11. Cancellation of a Stay

11.1. A reservation is confirmed once the Guest has paid the advance payment specified in the reservation terms.

11.2. The Guest may cancel the stay without incurring any charges if the Owner is notified of the cancellation at least 14 days before the scheduled start date of the stay.

11.3. In the event of a cancellation referred to in Section 11.2, the advance payment will be refunded to the Guest in full within 14 days of receipt of the cancellation notice.

11.4. If the Guest cancels the stay less than 14 days before the scheduled start date, the advance payment is non-refundable.

11.5. If the Guest fails to arrive at the property on the scheduled start date without having notified the Owner of the cancellation in advance, the advance payment is non-refundable.

11.6. Cancellations must be submitted in writing or electronically, in particular by email to the address provided in the reservation confirmation. The cancellation is considered effective when the notice is received by the Owner.

11.7. If the Guest cancels the stay for reasons attributable to the Owner, the advance payment will be refunded in accordance with applicable law.

11.8. Nothing in this section excludes or limits the Guest’s rights under mandatory provisions of applicable law.

12. Final Provisions

12.1. These Terms and Conditions are made available to the Guest before the reservation is made and are also available on the property’s website.

12.2. Any matters not covered by these Terms and Conditions are governed by the relevant provisions of Polish law.

12.3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
